Welcome to Float NWA. These Terms of Service ("Terms") govern your access to and use of the website floatnwa.com and any related tools, features, and content (collectively, the "Service"), operated by Natural State Lifestyles LLC, an Arkansas limited liability company doing business as Float NWA ("Float NWA," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
By using the Service, you confirm that you are at least 18 years old, or that you are using the Service with the consent and supervision of a parent or legal guardian, and that you agree to these Terms and our Privacy Policy.
Float NWA offers free, informational tools for planning float trips on Northwest Arkansas rivers, including live river-level data, weather, maps, put-in/take-out information, and related features. The Service is provided for general informational and recreational purposes only.
River-level, streamflow, weather, and mapping data are sourced from third parties such as the U.S. Geological Survey (USGS), Open-Meteo, and Google Maps. We do not generate this data and cannot guarantee its accuracy, completeness, timeliness, or availability. Data may be delayed, estimated, cached, or interrupted at any time.

The Service lets you submit content such as trip reports, hazard pins, notes, and photos ("User Content"). By submitting User Content, you:
User Content is displayed as unverified community information. We make no representation that it is accurate or current, and the absence of a reported hazard never means a river, creek, or section is clear or safe. So that hazard warnings reach people while they can still matter, serious hazard pins (strainers, low-water dams, log jams, fences, and sweepers) are published immediately, without prior review. That means they may be wrong, outdated, or malicious. Treat every pin as a useful rumor, not a fact. Conditions change constantly; a hazard pin may describe something that has moved, worsened, or washed away.
Float Mode and other location-based features are navigation aids, not safety devices. Before starting a trip in Float Mode you are asked to confirm that you understand this. You acknowledge that:
If you opt in, we may send emails or other notifications about river conditions (e.g., a river entering its typical floatable range). These messages are automated conveniences, not safety advisories. Alerts may be delayed, inaccurate, duplicated, or never delivered, and we have no duty to warn you of any condition, hazard, or change in conditions. Never make a go/no-go decision based solely on an alert. You can unsubscribe at any time via the link in each message.
The Service, including its design, text, graphics, branding, and original content, is owned by Float NWA and protected by applicable intellectual property laws. Third-party data and content remain the property of their respective owners. You may use the Service for personal, non-commercial purposes. You may not copy, redistribute, or create derivative works from our original content without permission.
The Service may link to or integrate with third-party services (e.g., USGS, Google Maps, Open-Meteo, and social platforms like TikTok). We are not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their own terms and privacy policies. Where Float NWA content appears on TikTok or other platforms, you also agree to comply with those platforms' terms of service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR CURRENT.
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND AFFECTS YOUR LEGAL RIGHTS.
You acknowledge that floating, paddling, kayaking, canoeing, wading, and related activities are inherently dangerous and that you participate voluntarily and at your own risk. Hazards include, without limitation, changing water levels, dam releases, cold water, strainers, fences, rapids, weather, and remote locations without cell service. Float NWA is an information service. We do not supervise, guide, inspect, patrol, or accompany any trip, and we are not a substitute for your own judgment, local knowledge, or a qualified guide.
To the fullest extent permitted by law, Natural State Lifestyles LLC (d/b/a Float NWA) and its members, managers, employees, agents, and contributors shall not be liable for any injury, death, property damage, or any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service, reliance on any information it provides (including User Content, alerts, forecasts, and Float Mode), or your participation in any water-based activity.
Cap on liability. If the limitation above is held unenforceable or inapplicable in whole or in part, then to the fullest extent permitted by law our total aggregate liability to you for all claims arising out of or relating to the Service will not exceed one hundred U.S. dollars (US$100.00) or the amount you have paid us in the twelve months before the claim arose, whichever is greater. The Service is provided free of charge, and this allocation of risk is a basis of the bargain between us.
Time limit for claims. To the fullest extent permitted by law, any claim arising out of or relating to the Service must be filed within one (1) year after the claim arises, or it is permanently barred.
Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.
We respect copyright. If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the work you claim is infringed; (3) identification of the material you want removed and where it is on the Service; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

We will remove or disable material in response to a valid notice and will notify the person who posted it, who may submit a counter-notice. We may terminate access for users who repeatedly infringe.
You agree to indemnify and hold harmless Natural State Lifestyles LLC (d/b/a Float NWA) and its members, managers, employees, agents, and contributors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time; when we do, we'll revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Arkansas.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. Our failure to enforce any provision is not a waiver of our right to do so later.
