Welcome to Float NWA. These Terms of Service ("Terms") govern your access to and use of the website floatnwa.com and any related tools, features, and content (collectively, the "Service"), operated by Float NWA ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Safety first. Float NWA provides informational data about river conditions for planning purposes only. Rivers are inherently dangerous and conditions can change rapidly and without warning. Water levels, flow rates, and weather displayed on the Service may be delayed, inaccurate, or unavailable. Never rely solely on this Service for safety decisions. Always check conditions in person, wear a proper personal flotation device (PFD), and use your own judgment. You paddle at your own risk.

Float NWA offers free, informational tools for planning float trips on Northwest Arkansas rivers, including live river-level data, weather, maps, put-in/take-out information, and related features. The Service is provided for general informational and recreational purposes only.

River-level, streamflow, weather, and mapping data are sourced from third parties such as the U.S. Geological Survey (USGS), Open-Meteo, and Google Maps. We do not generate this data and cannot guarantee its accuracy, completeness, timeliness, or availability. Data may be delayed, estimated, cached, or interrupted at any time.

The Service, including its design, text, graphics, branding, and original content, is owned by Float NWA and protected by applicable intellectual property laws. Third-party data and content remain the property of their respective owners. You may use the Service for personal, non-commercial purposes. The Service may link to or integrate with third-party services (e.g., USGS, Google Maps, Open-Meteo, and social platforms like TikTok). We are not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their own terms and privacy policies. Where Float NWA content appears on TikTok or other platforms, you also agree to comply with those platforms' terms of service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR CURRENT.

You acknowledge that floating, paddling, kayaking, canoeing, and related activities are inherently dangerous and that you participate voluntarily and at your own risk. To the fullest extent permitted by law, Float NWA and its operators shall not be liable for any injury, death, property damage, or any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service or reliance on any information it provides.

You agree to indemnify and hold harmless Float NWA and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time; when we do, we'll revise the "Last updated" date above. These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Arkansas.
